The following provides instructions for e-Service of a document:
1. Find your Case Home Page. (If you have already found your InSolve Case Home Page, please proceed to step 4).
Go to the CourtCanada home page, available at www.courtcanada.com . Select the 'Current Cases' tab at the top of the page.
2. Use the search tools on the Current Cases page to find your case listing. The Current Cases search tools allow you to search using part or all of the case name (i.e., the formal 'style of cause') or debtor name.
Alternatively, you can find your case home page by selecting the first letter of the debtor or case name. Selecting a letter will provide you with a list of cases currently registered for InSolve.
3. Select your case from the list.
Your search will generate a list of cases currently registered for InSolve. By selecting your case from the list you will be taken to your Case Home Page. If you do not see your case on the list, please verify the information you used in your search and try again, or contact us.
4. Register for the e-Service List for your case.
To access the e-Service system you will need to provide a registered e-mail address and password combination. (If your party is already registered for the e-Service List and you have a password, please proceed to step 6). Go to the e-Service List page by selecting the 'e-Service List' tab from the top of the Case Home Page.
Please note that the e-Court File System will not permit you to register for the e-Service List using an e-mail address from "public domains" such as yahoo.com, gmail.com, and hotmail.com. However, the Case Administrator (typically the Trustee or other Court-appointed officer) has authority to allow registrations for the e-Service List with any e-mail address.
Please contact the case administrator to arrange for registration on the e-Service List using an e-mail address from a public domain.
5. Go the e-Service List registration page by selecting 'Register for the e-Service List' on the e-Service List page.
Please complete the online registration form and select 'Register'. Note that at least one individual representative of your party must be designated as a "Public Authorized Individual". The names and e-mail addresses of each Public Authorized Individual will be publicly available on the e-Service List. InSolve also allows registered parties to designate a number of individuals as "Private Authorized Individuals". The names and e-mail addresses of Private Authorized Individuals will not be publicly available on the case web site. However, all Authorized Individuals have access to the party's e-Service List profile, including the ability to e-Serve documents on its behalf.
CourtCanada.com requires that the registration be confirmed before the party is added to the e-Service List. CourtCanada will automatically send the Authorized Individuals an e-mail message requesting that they confirm the registration by selecting a link in the body of the e-mail. Please note that only a Public Authorized Individual can confirm the registration. Until the registration has been confirmed by one of the Public Authorized Individuals, the registration will be considered incomplete. Incomplete registrations will appear listed on the e-Service List, but they will be noted as "unconfirmed" and will NOT be included on the e-Service List for the purpose of service of documents. New parties have 24 hours to confirm the registration on the e-Service List, failing which the unconfirmed party's informatio will be deleted.
Please note that if you wish to serve materials on an unconfirmed party through the e-Service System, you must manually add the e-mail addresses on the e-Service form.
6. Select the 'e-Serve Document' button from the tools on the left side of the web page.
7. Select 'Continue to e-Service of Court Document'.
You will be taken to the sign in page. You cannot access the e-Service system without a valid e-mail address and password combination.
8. Please sign in to InSolve by entering your e-mail address and password and selecting 'Submit' . You should have obtained a password when completing the e-Service List registration process. If someone else registered you as an Authorized Individual for a party in a case, you should have received an e-mail message from CourtCanada.com notifying you of the registration and requesting that you select a link in the e-mail to create your unique password. If you did not receive the e-mail message, then there may have been a problem with the information provided at the time of registration (e.g., a typographical error in your e-mail address). Please contact the person who made the registration and request that the information be reviewed and verified.
If you received the notification e-mail but cannot locate it, or have otherwise lost your password, note that the log in page provides for a new password to be forwarded to your registered e-mail address.
To become an Authorized Individual for a previously registered e-Service List party you must be added by a current Authorized Individual. If you are not registered as an Authorized Individual for a party on the e-Service List but would like to be added, please contact a current Authorized Individual and request the addition. You can view the Public Authorized Individuals for your party by selecting 'e-Service List' from the tabs at the top of the page, and then selecting the 'View the current e-Service List' link.
9. Complete the e-Service information form and upload the document that you are serving. (For information regarding the document specifications and other uploading requirements please view the e-Service Document Uploading Guidelines ).
The system requires that you provide detailed information regarding the document that you are serving. This information will be used to generate the text of the e-Service message that will accompany the document when delivered to the e-Service List as well as for the purpose of adding the document to the e-Court File for this case. Note that you will not have a subsequent opportunity to change the details of the document being served. However, you will have the opportunity to review and amend the text of the e-Service message to be delivered to the e-Service List. When you are satisfied with the information please select 'Submit', which will upload the document and generate a draft e-mail message to accompany the document.
10. Confirm the text of the service e-mail message and document details and e-Serve the document.
Carefully review the e-Service information and automatically generated draft text of the message that will be delivered to the e-Service recipients that you selected, and make any desired amendments to the message. When you are satisfied with the text and other e-Service details, select 'e-Serve Document Now'. Note that to serve the document you must first indicate your acknowledgment and acceptance of the site and system terms of use.
You should receive a message confirming service of the document. Provided the document was successfully served, it will immediately be available online in the Court file. For a summary of the service details, please view the e-Service Report for your document.
