Pursuant to the Order of the Honourable Mr. Justice Campbell of the Ontario Superior Court of Justice (Commercial List) dated March 4, 2005 (the "Initial Order") as amended, KPMG Inc. was appointed Receiver of Portus Alternative Asset Management Inc., Portus Asset Management Inc. and BancNote Corp. under Section 129 of the Securities Act (Ontario). The Initial Order was issued pursuant to an Application brought by the Ontario Securities Commission. Through a series of subsequent Orders including the Second Amended & Restated Order dated June 23, 2005, the receivership proceeding expanded to include a number of additional related domestic and foreign entities.
